Terms of Service (TOS)

These Terms of Service ("Terms") govern your access to and use of the PM Software Solutions websites, software, AI assistants, applications, and related services (the "Services") operated by PM Software Solutions, LLC ("we," "us," "our"). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Services.

1. Description of Services

PM Software Solutions provides digital tools and software solutions designed to support property management companies, including:

  • Custom-built websites and web applications
  • AI-powered assistants (process, sales, training, email, support, and onboarding)
  • A user-facing SaaS platform with account management and training tools
  • Third-party integrations (for example, Google authentication, Stripe payments, OpenAI processing)
  • Consulting, configuration, and system implementation support

We may update or add new features as our Services evolve.

2. Eligibility

You must be:

  • At least 18 years old, and
  • Authorized to act on behalf of a business if you are using the Services for commercial purposes

The Services are intended for professional use within the property management industry.

3. Account Registration

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your login credentials
  • Notify us immediately if you suspect unauthorized access
  • Be responsible for all activity under your account

You may register using Google Authentication, in which case Google may provide us with basic profile details (for example, name and email).

4. License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for business purposes.

You agree not to:

  • Reverse engineer, decompile, or copy the Services
  • Interfere with or disrupt the platform
  • Attempt to bypass security or authentication
  • Upload malicious code
  • Use the Services to develop competing products
  • Misuse any AI capabilities, including for illegal, harmful, or deceptive activities
  • Use AI products in violation of OpenAI’s policies or any applicable provider terms

We may suspend or terminate accounts for violations.

5. AI-Powered Features

Some features use artificial intelligence ("AI") provided by third-party vendors such as OpenAI. By using AI features, you acknowledge that:

  • Your inputs and outputs may be processed by AI service providers
  • AI-generated results may contain inaccuracies
  • You are responsible for evaluating AI outputs before relying on them
  • You will not use AI features for prohibited or harmful purposes
  • You will comply with OpenAI’s and other vendors’ usage policies

We do not guarantee accuracy or suitability of AI-generated content.

6. Payment, Billing & Subscriptions

If your use of the Services requires payment:

  • Payments are processed securely by Stripe
  • Fees, billing cycles, and plan details are disclosed during checkout
  • Subscriptions renew automatically unless cancelled
  • You authorize recurring charges to your payment method
  • We may change pricing with notice to affected users

Failure to pay may result in suspension or termination of your access.

7. Third-Party Services

The Services may integrate or rely on third-party providers, including Google (authentication), Stripe (payments), and OpenAI or similar AI providers (AI functionality).

We are not responsible for third-party services. Your use of them is subject to their respective terms and privacy policies.

8. Intellectual Property

All content, code, features, and materials provided through the Services—including AI models, user interface, design, and branding—are owned by PM Software Solutions or our licensors.

You may not:

  • Copy, modify, or distribute platform materials
  • Use our trademarks without permission

9. Termination

We may terminate or suspend access to the Services at any time for violations of these Terms or for security or legal reasons.

You may terminate your account at any time by contacting us at hello@pmsoftwaresolutions.com. Upon termination, your license to use the Services ends immediately.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

  • The Services will be uninterrupted or error-free
  • AI outputs will be accurate
  • Data will never be lost

To the fullest extent permitted by law, we disclaim all warranties.

11. Limitation of Liability

To the extent allowed by law, PM Software Solutions is not liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits or business interruption
  • Errors in AI-generated content
  • Unauthorized access or data breaches beyond our reasonable control

Our total liability will not exceed the amount you paid us in the last 12 months, if any.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of:

  • Your use of the Services
  • Violation of these Terms
  • Misuse of AI features
  • Content you input, generate, upload, or transmit

13. Changes to the Terms

We may modify these Terms. Updates will be reflected with an updated "Last updated" date. Your continued use of the Services means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which PM Software Solutions is registered, without regard to conflict-of-law principles.
